Thermo Fisher Scientific Senior Manager, Litigation in Waltham, Massachusetts

Position Summary:

Candidate will work closely with the Senior Director, Litigation and Chief Counsel, Litigation, other members of the Global Legal Department, business leaders, Risk Management, the Communications Department, insurers, auditors, consultants and outside counsel managing litigation and threatened claims against all Thermo Fisher businesses worldwide.

Key Responsibilities will include:

  • Managing and directing outside litigation counsel in an efficient, effective manner in order to reduce litigation costs

  • Managing complex and diverse litigation involving commercial and government contracts, product liability, vendor, customer and distributor disputes, real estate, intellectual property, environmental, insurance coverage, antitrust, unfair trade practices, false advertising, personal injury and property damage claims

  • In selective and appropriate cases, handling matters without outside counsel

  • Responding to demands, threatened claims, subpoenas, requests for information from government agencies, investigators and other third parties

  • Engaging in early intervention and dispute resolution to resolve threatened claims

  • Engaging in early case assessment by conducting factual investigations, interviewing employees, reviewing documents to determine strengths and weaknesses of the Company's case

  • Providing advice and counsel on a day-to-day basis regarding disputes and litigation

  • Negotiating settlements in appropriate cases; overseeing alternative dispute resolution

  • Implementing the Company's Records Retention Program, including working with the Director of Records Management and the IT Department on information governance issues, litigation holds and e-discovery issues

  • Assisting in the mergers and acquisitions due diligence process

  • Working pro-actively across multiple business units, establishing and maintaining effective relationships with key members of management and staff, and serving as a liaison between the businesses and outside counsel

  • Keeping abreast of legal developments in areas of interest to the Company including e-discovery, cybersecurity, privacy, social media, class actions, etc.

  • Assisting with the development and implementation of legal and risk strategy, as appropriate

Minimum Requirements/Qualifications:

  • Bachelor's Degree and Juris Doctor Degree

  • Minimum of 5 years large law firm experience; additional in-house legal department experience a plus

  • At least 5 years of experience handling a full range of litigation matters including general commercial contracts and product liability claims

  • Ability to take initiative, assume responsibility and quickly gain credibility
